Negligence generally means when the party at fault fails to act with reasonable care, in circumstances when he has a duty of care towards you, and breaches that duty and causes injury to you. Strict Liability – does not require any negligence or intent. usually occur when there is a standard set in law and the person fails to meet that standard – as in t he case of someone involved in the production, distribution, sale of a defective product which cause injury…. any of these person may be liable under strict liability principles.

A personal Injury case is is a case brought under the Civil Jurisdiction of the Court. A Claim is filed either in the High Court or in the Magistrate Court if the amount sought is no more than $7500. These small claims may also be brought in the High Court but, the successful claimant will not be entitled to any costs.
